Terms And Conditions Of Sale

www.silhouettebeauty.com is a Trade Only online store. All products and information are intended only for qualified professional beauty therapists or those studying towards a beauty therapy qualification.

Silhouette International LLP (NW) reserve the right to request proof of trading or proof of qualifications before processing your order internally. Silhouette International LLP (NW) are entitled to issue non-trade customers with a refund should they

1) be found not to be a trading professional or qualified professional and

2) not be able to provide proof of trading or qualifications upon request.

All goods are for sale on a strictly business to business basis. Customers should be competent in using the products sold on this website. Silhouette International LLP (NW) will not be responsible for any injury or damages involving unqualified users of our products. We reserve the right to ask for proof of professional status, and refuse the order if we believe the person not to be a trade customer. As a business user it is your responsibility to ensure that you are insured for the products that you are using. Products will not be sold the general public.

1. Definitions:

In these Conditions

  • The seller means Silhouette International LLP (NW)
  • The goods means the goods specified on the invoice
  • The buyer means the name specified on the invoice, (or where such Person acts as agent for another, that person and the Principal jointly and Severally) buying the goods
  • United Kingdom means Great Britain, Northern Ireland, the isle of Man and the Channel Isles
  • The Contract means the bargain recorded in the confirmation between the Seller and the buyer which includes these conditions except as expressly excluded by the seller in writing.

2. The Contract Between Us

To make purchase from our website, you must complete the online registration form. A binding contract for the sale and purchase of goods between you and us will only come into effect when we issue you the confirmation of order and an order reference number to the e-mail address provided by you on the registration form. We are not obliged to accept any order(s) you submit.

3. Price & Payment

We reserve the right to revise at any time the price of goods offered for sale on our web site without notice. All orders for goods are subject to availability and Silhouette International LLP (NW) reserves the right to refuse to supply to any individual or company for whatever reason.

Although Silhouette International LLP (NW) tries to ensure that prices on this web site are accurate, errors can sometimes occur. (The prices as stated are therefore, indicative only but an accurate total price, including delivery charges, will be confirmed to you when we send you confirmation of our acceptance of your order.) If the price when confirmed is not to your satisfaction your sole remedy is to withdraw your order and return the goods, to us in an unused condition, if already delivered to you.

All prices are exclusive of VAT and are quoted in British Pounds Sterling unless otherwise stated.

Payment in full is required to be made by (any of the following credit cards Visa, Mastercard, Maestro, or Delta) through this web site prior to despatch of goods.

4. Delivery

We try to deliver the goods in accordance with the delivery times and charges set out below. Please note the delivery times stated below are indicative only and we are not responsible for any delays. Neither Silhouette International LLP (NW) or their designated carrier will accept claims for consequential loss due to late deliveries.

Orders will be processed within 24 hours and despatched within 1 – 7 working days. Delivery in the UK is £6.95 net per parcel. Parcels will be sent by our nominated carrier service or by Royal Mail First Class. We reserve the right to make an extra charge for re-delivery if you are not available to accept or receive the goods when delivered to you.

Please note any items not delivered to you will be held on backorder for you and shipped as soon as they become available.

5. Tax And Other Charges

We charge UK VAT at 20% on all orders. Delivery within the UK.

All local customs, excise, value added and import taxes are your responsibility and we will not pay these charges.

In addition, we will not be responsible for any costs, fines, taxes or duties incurred as a result of goods being seized outside the United Kingdom. We will not provide any refunds or credit notes in these circumstances.

6. Product Descriptions

In describing the Products available on our web site we attempt to be as accurate as possible. Silhouette International LLP (NW), however, does not warrant that Products descriptions or other content of this web site is accurate, complete, reliable or error-free. If a Product offered by us is not as described, your sole remedy is to return the Product in an unused condition in accordance with the provisions detailed below.

7. Your Account

If you use our web site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account and all passwords. To place an order on this web site, you must be a qualified trading beauty therapist or beauty therapy student (over the age of 16 years) otherwise you are not entitled to complete the on-line registration form required to place an order. We reserve the right to refuse service, terminate accounts or cancel orders at our sole discretion.

We will deliver the goods ordered by you to the address given by you for delivery on the on-line registration form at the time of your order and by whatever means we reasonably consider appropriate.

8. Returns And Refunds

It is your responsibility to inspect the goods immediately upon receipt and contact us by telephone or e-mail if you do not receive your order or the items appear to be damaged or faulty within 48 hours.

If you believe you have received damaged or incorrect goods, you must contact us by e-mail or in writing within three working days of your receipt of the goods and provide us with your order reference number. We will have the goods returned to us and pay the costs of the return shipping. If we do not receive notification within seven days, any shortage, damage or other deficiency will be deemed to have occurred after delivery to you.

If, in our opinion, the returned goods are damaged we will provide you, at our option, with replacement goods or a refund for the total costs of the goods within 30 days of our receipt of the returned goods provided you have complied with the provisions above.

If we find that the goods are not damaged or faulty, we will return the ordered goods to you and you will be responsible for the cost of the return shipping. We will also charge you an administration fee of 10% of the cost of your original order.

When goods have been ordered in error or as not expected, the Seller may agree to their return on the following conditions.

A request must be made to Silhouette International LLP (NW), within seven days of receipt of goods.

If you wish to return unwanted goods, please ensure that any product you have bought is in original condition, or unused and sent back to us with its original packaging. Your statutory rights are not affected.

Refunds will be subject to the purchase price less a 10% + VAT handling charge. Carriage charges will NOT be refunded.

If you have bought a machine and we have travelled to you to carry out training on the machine, you have a liability to contribute towards the training. This would be a minimum charge of £200 +VAT for a days training and will be deducted from any refund.

For your own protection, please obtain a receipt from the carrier, as the company accept no responsibility for lost parcels.

Goods which are given free, as part of an offer, are not exchangeable or refundable unless the full offer is returned, subject to normal terms and conditions.

Special or customised items cannot be returned unless faulty.

If you choose to return an item to Silhouette International LLP (NW) please allow 14 days for administration.

9. Loss Or Damage In Transit:

If the goods be damaged in transit, or having been placed in transit have not been delivered:

In the cases of damage, written notice must be provided within 3 days of delivery.
In the case of non delivery, written notice shall be provided within 14 days of the date of invoice or advice dispatch. Each written notice shall be sent by first class letter post to the Company, also to the carrier when the name of the carrier is shown on the invoice or advice note. The liability of the company shall be limited to the repair of The goods or replacement within a reasonable time The Company cannot be held responsible for any damage or loss if, by reason of failure by the Buyer Or his or his representative to give notice of damage or non-delivery as above provided the Company is prevented from recovering compensation from any third party. In respect of goods for export, the company shall not be held responsible for any damage to or loss of goods beyond the point of shipment at UK port. When the bills of lading are arranged by the Company, the goods will be insured in the name of and at the expense of the Buyer.

10. Third Party Claims

The company shall be under no liability to the Buyer in respect of injury or Damage caused by goods supplied where such goods have not been used as Recommended by the instruction issued for such goods or by any defects Caused by negligent misuse of handling.

11. Guarantee

The equipment is guaranteed for 12 months from the date of delivery on components and workmanship. This guarantee covers the cost of parts and labour involved in repairing or correcting equipment, but not the carriage or transport charges incurred, which shall be borne by the Buyer. If in the opinion of the company damage in any form has resulted from misuse of the equipment in any way whatsoever, then the guarantee shall be null and void, repairing such damage as has occurred being entirely charged to the customer. Modification of, or tampering with the equipment by persons not authorised by the Company maybe regarded by the Company as Invalidity of the guarantee. Furthermore, any defect in the equipment must be notified with 3 days of discovery, failing which this guarantee is null and void.

12. Exception To The Guarantee

Equipment is guaranteed for the period of 12 months with the exception of, glass tubes glass jars bulbs, electrodes, Perspex plates, needle holders, thermo-probes and pads, Blankets and cables, as these are classed as consumables.

13. Cancellation & Changes To Order

After, acceptance of an order by the seller. Orders shall not be subject to cancellation. Except with the agreement of the company, and unless the cancellation, alteration or ancillary charges are paid by the buyer. These charges are Calculated as follows:- 15% of the total invoice or quoted price. Goods bought by credit card facilities shall be subject to a further 5% admin charge. Delivery & handling charges will be charged separately at the cost price + 5%. Refunds will not be given. Any residue or net amount due after deductions have been made; will be credited to the buyers account.

14. Termination

We reserve the right to terminate immediately your ability to use any of our internet services at any time.

15. Contract Conditions

This contract contains all the terms and conditions of purchase and sale relating to the supply of the products to which it relates. No further conditions will be recognised by or binding on either party hereto apart from the actual quantities, prices delivery dates and relevant discounts. Not withstanding that such conditions may be amended to any documents exchanged between all parties referred to.

16. General

Goods are sold on the understanding that they will only be used for the intended purpose. No responsibility will be accepted by Silhouette International, for trained or untrained personnel without qualified supervision using or misusing products supplied by us. All offers in the catalogue are subject to stock availability and we reserve the right to restrict or refuse an order at any time. In exceptional circumstances, if an article is unavailable, we may send a carefully selected substitute, after agreement between both parties.

17. Law

This contract shall be governed exclusively by the Laws of England The Buyer hereby accepts the jurisdiction of such courts or tribunal whether in England or elsewhere, as the Seller may nominate for the purpose of trying any action arising out of this Contract.

18. Acceptance

Completion of the online registration form will be treated by the company as an acceptance of these terms.

19. Sale Of Goods Act 1979

None of the above effect the Buyer’s or the Seller’s rights under the Sale of Goods Act 1979.
